THE FLORIDA CONSTRUCTION LIEN LAW (FLORIDA STATUE 713)
The Construction Lien Law in Florida provides that states that those who work or provide materials for your property and are not paid in full may have a right to enforce their claim for payment against your property. This claim is known as the Construction Lien.
A Notice of Commencement must be filed with the Clerk of Circuit Court before beginning home construction.
If you intend to get financing, consult with your lender before recording your Notice of Commencement (NOC). The NOC should be posted at the job site to let all parties know who to notify regarding payment.
A Notice to Owner may be sent to you during the construction of your home. These notices are to let you know that the sender has supplied materials or provided labor/services for your home.
It is important that you contact your builder to obtain a Waiver and Release of Lean upon progress payment (this is during your construction phase). This document states that partial payment has been made, i.e., first rough.
